When a medical emergency strikes and you are 8,000 miles away, who makes decisions for your parents? A Medical Power of Attorney (MPOA) — also called a healthcare proxy — ensures someone you trust can authorize treatment, access records, and make critical decisions when your parents cannot.
What Is a Medical Power of Attorney?
An MPOA is a legal document where your parents designate a trusted person (the "agent") to make healthcare decisions on their behalf if they become incapacitated. In India, this is typically structured as a Specific Power of Attorney for Medical Decisions and must be registered with the sub-registrar.
What It Covers
- Consenting to or refusing medical treatment
- Accessing medical records and test results
- Authorizing surgery or emergency procedures
- Choosing hospitals and doctors
- Making end-of-life care decisions (with specific clauses)
- Discharging or transferring the patient
How to Set It Up from Abroad
NRIs can execute an MPOA through these steps: (1) Draft the POA with an Indian lawyer specializing in family/elder law. (2) Print it on stamp paper of appropriate value (₹100–₹500 depending on state). (3) Sign it in the presence of a notary in your country of residence. (4) Get it attested by the Indian Embassy/Consulate. (5) Courier it to India for registration with the local sub-registrar. Alternatively, visit India during a trip and register it in person.
Important Considerations
The agent should be someone physically present in India or able to travel quickly — typically a sibling or trusted relative. If no suitable relative is available, some families designate a trusted family lawyer. The MPOA should clearly state whether it is immediate (effective from signing) or springing (effective only upon incapacitation, requiring doctor certification).
How Corelatin Fits In
While Corelatin companions cannot make medical decisions (they are non-medical support personnel), they play a vital supporting role: when the MPOA agent needs information from the hospital, the companion can physically visit the MRD, collect records, and facilitate communication between the hospital and the agent abroad.
